India’s first brewery licensed in 1862 by the British Government. Alcohol = state subject in India (no national policy). Each state issues its own liquor licenses. License = gives the RIGHT. Permit = allowance to act. All licenses/permits issued for ONE year (renewed annually). Must be displayed at bar.

⚖️ Legal Framework

Alcohol industry = most regulated industry in the world. India: no national alcohol policy — state subject. Each state has own laws. Central Excise Laws apply additionally. First brewery licensed in India: 1862 by British Government. Indian law covers 3 areas: 1) Sales to public 2) Internal bar operations 3) Retailer-wholesaler relationship. Licenses and permits issued for ONE year, renewed annually. Must be displayed at appropriate position in bar. Key references: Punjab Excise Act, 1914 and Delhi Liquor Licensing Rules, 1976.

License vs Permit: License = gives the RIGHT. Permit = allowance to act in a certain manner. Both allow selling/dispensing alcoholic beverages to the public.

📋 Classification of Liquor (Punjab Excise Act, 1914)

Country Liquor: All liquor other than rectified spirit, denatured spirit and perfumed liquor. Not imported. Made from neutral spirit + demineralized water + spices/essences. Does NOT imitate imported liquors. Sold at prescribed strengths at country liquor shops. Includes “laban” = “Punjab Medium Liquor.”

Foreign Liquor: Imported into India by sea or air in original bottled form. Also includes: all beer/porter/stout/cider imported from abroad · wines made from grapes/fruit imported from abroad · liquors manufactured IN India in imitation of foreign liquor (IMFL = Indian Made Foreign Liquor) · all beers/stout manufactured in India.
IFL (Bottled in Origin): Foreign liquor imported from abroad on which customs duty is leviable.

OFF-PREMISES (Consumption outside licensed premises)

L-1
Obtained by the MANUFACTURER for selling liquor in a particular state.
L-2
Issued to RETAILER to sell IMFL/BEER in the state. DSIDC and DTTDC act as retailers on behalf of Delhi Government.
L-6
To sell IMFL/BEER in DUTY-FREE SHOPS.

ON-PREMISES (Consumption at licensed premises)

L-3
To serve alcoholic drinks in ROOMS to RESIDENT GUESTS in hotels. Drinks served round the clock (24 hours).
L-4
Permits to sell alcoholic beverages in STAND-ALONE BARS and restaurants. Serves IMFL, Beer and Foreign Liquor.
L-5
Required to serve IMFL/BEERS in BARS OF A HOTEL to general public.
L-5A
Obtained to serve foreign liquor/beers on LUXURY TRAINS (e.g. Palace on Wheels).
L-18
Permits EXTENSION OF HOURS OF OPERATIONS for an L-3, L-5 or L-4 license holder.
L-19
CLUBS required to serve alcoholic drinks to MEMBERS (e.g. Gymkhana Club, Golf Club etc.).
L-19A
Permits to sell alcoholic drinks to GOVERNMENT SERVANTS in mess — Army clubs, armed forces messes, DSOI.
L-20
Obtained by the HOST to serve liquor in PRIVATE FUNCTIONS at hotels/clubs/restaurants. Issued in name of host. Fee: ₹5,000. Premises must hold L-3, L-4, L-5, L-19 or L-19A.
L-49A
For HOST to serve at PRIVATE FUNCTIONS (e.g. marriage) at any location (need not be licensed premises). Restriction: alcohol only served to persons above 25 years of age.
L-53
DEPARTMENTAL STORES or MALLS to sell beers and mixed alcoholic beverages in their retail vends.
